Please read before placing a booking
Formation of the Contract & Definitions
1. The booking of Gateholm, Marloes, Pembrokeshire SA62 3BE (“Gateholm”) is a legally binding contract for hiring Gateholm for the period specified on the booking summary (“ the holiday period”). You should only enter the contract if you have read these terms and conditions and agree to be bound by them.
2. The contract is between John and Sarah Hayes ("the owners") and the person who has submitted the booking form ("the hirer").
3. The hirer must be over 18 years of age. Bookings from persons under the age of 18 cannot be accepted.
4. By submitting a booking, the hirer is making an offer. This offer creates a “provisional booking” but no contract is created until such time as:
a) The deposit (or, in the case of a booking less than 42 days before the start of the holiday, the full amount) has been paid by the hirer and received by the owners; AND
b) The owners have notified the hirer (by e-mail or otherwise in writing) that the booking is accepted.
5. Upon fulfilment of conditions (a) and (b) above, the contract will be formed and the booking will become a “confirmed booking”.
6. In the event that the owners do not accept the proposed booking, the owners will notify the hirer (by e-mail or otherwise in writing) and the owners will refund in full to the hirer any monies (whether by way of deposit and/or the full amount) already paid by the hirer.
7. Gateholm is hired as a short-term holiday home only. No tenancy is created.
Payment Conditions:
8. At the time of booking, the hirer shall pay to the owners a deposit representing 30% of the full cost of the holiday.
9. The balance shall be paid by the hirer to the owners at least 6 weeks (42 days) prior the start of the holiday period.
10. In the event that a booking is made less than 42 days before the selected start date, the full cost of the holiday shall be payable at the time of booking.
Cancellation by the Owners:
11. If, due to circumstances beyond the control of the owners, Gateholm becomes unavailable for hire prior to the commencement of the holiday period, the owners have the right to cancel the contract. In such circumstances:
a) The owners shall refund in full to the hirer any monies paid by the hirer; AND
b) The hirer shall have no further claim for monies or compensation against the owners.
Cancellation by the Hirer
12. The hirer accepts that it is the hirer’s sole responsibility to take out holiday cancellation insurance - (Please Note: The owner strongly advises the hirer to take out such insurance cover).
13. In the event that the hirer seeks to cancel the holiday, the following conditions shall apply:
a) The deposit (30%) shall not be refunded in any circumstances (such sum to be retained by the owners to cover the time and expense of processing the cancellation, re-advertisement and/or re-hiring of Gateholm for the holiday period);
b) The hirer shall take steps immediately to notify the owners by e-mail (or otherwise in writing) of the proposed cancellation so that the owners can take steps to re-advertise the holiday period as available for hire on Gateholm’s website (www.gateholm.co.uk);
c) In the event that Gateholm is re-hired by the owners to a different customer for a period representing whole or part of the holiday period, the following shall (where applicable) apply:
i) In the event that:
(1) the full cost of the holiday has already been paid by the hirer; and
(2) Gateholm has been re-hired for the same (or a higher) amount
a sum representing 70% of the full cost of the holiday (i.e. the “balance” payment”) shall be repaid to the hirer
ii) In the event that:
(1) only the deposit (30%) has been paid by the hirer; and
(2) Gateholm has been re-hired for the same (or a higher) amount
the sum representing 70% of the full cost of the holiday (i.e. the “balance” payment”) shall no longer be payable by the hirer;
iii) In the event that:
(1) the full cost of the holiday has already been paid by the hirer; and
(2) Gateholm has been re-hired for a lower amount,
a sum representing 70% of that lower amount shall be repaid to
the hirer;
iv) ln the event that:
(1) only the deposit (30%) has been paid by the hirer; and
(2) Gateholm has been re-hired for a lower amount,
a sum representing 70% of “A” (where A = the difference between full cost due from the hirer and the lower amount) shall be payable by the hirer (in substitution for 70% of the full cost).
d) In the event that Gateholm is not re-hired for the holiday period, the full cost of the holiday shall remain due from the hirer or shall be retained by the owners (as the case may be) and no refund or compensation shall be payable to the hirer.
Hirer Obligations:
14. The hirer agrees to be bound by the following specific obligations:
a) No Smoking: There is a strict no smoking policy at Gateholm.
b) No pets (except guide dogs) are permitted at Gateholm.
c) The owners do not provide bed linen and towels. It is the responsibility of the hirer to bring sufficient bed linen (i.e. bed sheets, quilt covers and pillow cases) and towels for use by all members of their party during the holiday period. For hygiene reasons, the hirer shall ensure that all beds (in use) are properly made up with bed linen during the whole of the holiday period.
d) Permitted Occupants – Except with the prior written agreement of the owner, the hirer:
i) Shall not exceed the maximum number of people permitted to stay at Gateholm (maximum of 6 plus infant(s) in a travel cot;
ii) Shall not share Gateholm with anyone not nominated on the booking form;
iii) Shall nor sublet Gateholm or assign the booking to anyone else.
15. Failure by the hirer to comply with the above conditions (in clause 14) shall have the following consequences:
a) The immediate cancellation of the holiday contract;
b) The hirer and all members of the hirer’s party shall forthwith vacate Gateholm; and
c) No refund or compensation shall be payable to the hirer.
Arrival & Departure:
16. Unless otherwise agreed in writing with the owners:
a) The changeover day will be Saturday;
b) Gateholm will be ready for occupation from 3.00 pm onwards on the specified day of arrival;
c) The hirer shall vacate Gateholm by 10.00 am on the specified day of departure.
17. On departure, Gateholm must be left in a clean and tidy condition by the hirer. In particular, the hirer will ensure that the kitchen (including the cooker, microwave, fridge, sink, pans, crockery, cutlery and all other equipment and utensils) and the shower, bathroom and toilets are left in a clean and tidy state.
Loss & Damage:
18. The owners shall not be liable to the hirer or any member of their party or visitors for any accident, loss or damage to such persons or their property howsoever caused.
19. The hirer shall take immediate steps to report any breakages and/or damage to the owners and shall pay to the owners the reasonable costs of replacement and/or repair prior to the hirer’s departure from Gateholm.
Access:
20. The hirer shall permit the owners and/or their agents reasonable access during the holiday period to Gateholm:
a) to attend to any matter of complaint;
b) to attend to any repair or other maintenance;
c) to mow the lawns.
